These Terms of Service ("Terms") govern access to and use of Dealix (the "Service"), provided by Dealix ("we", "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the dealership you represent.

1. Accounts

You must provide accurate information when creating an account and are responsible for activity that occurs under your account, including actions taken by team members you invite. You must keep your login credentials secure.

2. Subscriptions and billing

3. Acceptable use

You agree not to use the Service to send unsolicited or unlawful messages (including via SMS), to store data you don't have the right to process, to attempt to disrupt or reverse-engineer the Service, or to use it for any purpose that violates applicable law.

4. Your data

You retain ownership of the customer, lead and vehicle data you upload to the Service. You are responsible for having the appropriate legal basis and consents to process that data, including for messages sent to your leads and customers. You can export your data at any time, and it will be deleted from active systems within a reasonable period after account closure, in line with our Privacy Policy.

5. Service availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, and third-party services we rely on (such as messaging or email delivery) may occasionally be unavailable outside our control.

6. Limitation of liability

To the maximum extent permitted by law, Dealix is not liable for indirect, incidental or consequential damages arising from use of the Service. Our total liability in any circumstance is limited to the fees paid by you in the twelve months preceding the claim.

7. Termination

We may suspend or terminate accounts that breach these Terms, engage in fraudulent activity, or fail to pay outstanding fees, after reasonable notice where practical.

8. Governing law

These Terms are governed by the laws of England and Wales.
